NetHook Privacy Notice

At NetHook, we recognise that privacy is important. This Privacy Notice ("Notice") describes how Ourdevtool. ("Ourdevtool", "we", "our" or "us") collects, processes, and protects personal data about you through the NetHook App (the "App"), www.ourdevtool.com, and all other OurDevTool websites and applications (collectively, the "Services") that link to this Notice. This Notice also describes your rights in relation to your personal data.

Ourdevtool is the controller of your personal data. If you have any questions about this Notice or how we use your data, our details are provided in the "Contact Us" section below.

This Notice may be provided in more than one language. In the event of any conflict, where permitted under local law, this English language version of the Notice shall prevail.

1. PERSONAL DATA THAT WE COLLECT

We automatically collect certain information when you visit, use or navigate the App . This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as browser and device characteristics, operating system, language preferences,device name, country, location, information about how and when you use our App and other technical information. This information is primarily needed to maintain the security and operation of our App , and for our internal analytics and reporting purposes.

Among the types of Personal Data that this Application collects, by itself or through third parties :

Network experience data : If you are a user of one of our Mobile Applications, when allowed access to your data, we collect data from your mobile device when you are using our app .
We take measurements from your device when using the app including location data (  without GPS  ), network type,  Wifi signal strength and quality, and the identifiers of connected Wifi station (including both BSSID and SSID) ,MAC address of access point. time,  captive portal login steps ,your mobile operating system,device model,unique device identifiers ,We also collect additional points that are interesting in order to measure and analyze network and internet performance,We measure the performance of the data connection including the speed, responsiveness and reliability along with the total amount of data transferred. We do not monitor the content of your data usage, collect personal demographic data on users such as the name, age, gender, telephone number or any other demographic data. We also do not collect any information about the use of your device such as apps used, or the content accessed. The goal of collecting the above device data is to measure the experience you have of wireless networks and to let your local internet service provider improve his services depending on this informations (Wi-Fi operators have access to your connection information once you use their services even without using the app).

Camera: we may ask you for camera permission just for reading the QR code of internet voucher .

subject to requirements under applicable law, coarse geolocation data, such as location information we receive about you (e.g., based on your IP address, Wi-Fi SSID, etc.); and
data you input : like voucher codes for local internet service provider , reports you send about any part of your local service provider , your app settings and preferences for app functionality.

Analytics. We collect, measure and analyze traffic and usage trends relating to users’ use of our Mobile Applications, and we use third-party analytics tools to help us do so. This allows us to understand, among other things, how users use our Mobile Applications, and ways to improve them. These third-party analytics tools use cookies and persistent device identifiers to collect and store information including, but not limited to, time of visit, pages visited, time spent on each page, unique device ID and type of operating system used , device event information such as system activity .

When you first use our Mobile Applications a random identification code (“device ID”) is generated by our software and allocated to your mobile device and used to identify your device whenever we take measurements. To further help us manage the data, we also collect related IP addresses, the device MAC number, the Android serial number. These fields are needed to provide the Service and statistical purposes, for example to understand how much data is contributed by each device.

Log and Usage Data. Log and usage data is service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our App and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the App (such as the date/time stamps associated with your usage, pages and files viewed,  and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps') and hardware settings).

Transactional information (e.g., information relating to any of your requests, queries, or complaints);

We collect, store and use your personal information including your information about how you use and access the Service because it is necessary in order to provide the Service requested by you pursuant to the contract made between you and us. If you do not provide us with this information we will not be able to provide you with the Service.

Use of information with Your Consent. We may use your personal data for any other purpose for which you specifically provide us with your consent.

2. HOW WE USE YOUR PERSONAL DATA AND THE BASIS ON WHICH WE USE IT

We may use your personal data for the following purposes:

  1. network operation: Measurements that we take from the mobile devices of individual network users allow us to create a detailed picture of the service availability, quality and performance of numerous wifi networks across the world and we provide some of the statistical data that we generate to our customers (such as network operators) to help them understand their own network’s service coverage, performance and signal quality. Although the end-product we produce is made up of aggregated anonymized data, the underlying ‘raw data’ which contains personal data of individual users is important for generating statistical data, validating the results, quality control and further analysis. 
  2. contractual obligations: we use your personal data to meet our contractual obligations to you under our terms and conditions of use or to take steps at your request prior to entering into such contract;
  3. service operations.We share your Wi-Fi connection information when you connect to the devices of your local Internet service provider to enable control of the services provided to you ,give them an overview of the performance of the service, and to give you the ability to control the service provided to you,
    The information provided by you does not refer to you or any of your contact information;
  4. service improvements: we analyse usage information, including site analytics, to continually improve the user experience;  
  5. communications: communications may include providing information about changes to the terms and conditions, updates regarding our Services, or responses to questions you pose;  
  6. exercising our rights: we may use your personal data to exercise our legal rights where it is necessary to do so, for example to detect, prevent, and respond to intellectual property infringement claims or violations of law;
  7. complying with our obligations: we may process your personal data to carry out fraud prevention checks or comply with other legal or regulatory requirements, when required by law;
  8. advertising and marketing .Deliver targeted advertising to you,We may use your information to develop and display personalized content and advertising (and work with third parties who do so) tailored to your interests and/or location unless you have opted out, in which case you may receive generic or contextual advertising;

We must have a legal basis to process your personal data, as specified under applicable laws. In most cases the legal basis will be one of the following:

  1. as consented by you in respect of this Notice;
  2. to fulfil our contractual obligations to you, for example to provide the services you request;
  3. to comply with our legal obligations, for example to enable us to meet our fraud prevention;
  4. where permitted under applicable laws, to meet our legitimate interests, for example:
    1. to understand how you use our services and to enable us to derive knowledge that enables us to develop new services;
    2. to carry out data analysis to ensure the stability and security of our Services and prevent crime, fraud and misuse of our Services;
    3. to provide advertising to users , which keeps most of our services free; and
    4. to improve user experience.

    When we process personal data to meet our legitimate interests, we put in place robust safeguards to ensure that your privacy is protected;

  1. we may obtain your separate consent to collect and use certain types of personal data when we are required to do so by law (for example, in relation to our direct marketing activities). If we ask for your consent to process your personal data, you may withdraw your consent at any time by contacting us using the details at the end of this Notice; and
  2. as otherwise may be permitted under applicable laws.

3. HOW AND WHEN WE SHARE YOUR PERSONAL DATA

We may share your personal data as follows:

  1. With our service providers and other third parties that perform marketing services and support our other business operations. For example, we may partner with companies to send marketing messages,  and analyse information. These service providers may include cloud service provider, advertising agencies and fraud prevention agencies which will use your personal data only in the ways described in this Notice.
  2. With advertisers and third-party measurement companies to show how many users of the App have clicked on that advertisement.
  3. With our affiliate companies, joint venture partners, and other partners or collaborators for the purposes of processing, analysing, or storing your information or otherwise as needed to provide the Services to you or achieve other purposes for which we collect information, in each case, consistent with the terms of this Notice.
  4. With law enforcement agencies, courts, other government authorities (whether in your jurisdiction or abroad) or other third parties where we or any of our affiliates believe it's necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party.
  5. With potential transaction partners, service providers, advisors, and other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell or transfer all or a portion of our assets or business. Should such a sale or transfer occur, we will use reasonable efforts to obligate the entity to which we transfer your personal data to use it in a manner consistent with this Notice.
  6. Joint and Independent Controllers. We share some of the raw measurements that we collect from users’ mobile devices with of our customers ( local wifi service provider ) under the terms of data license agreements and data sharing agreements. some of the data we share with our customers contains personal data such as datasets containing the internet provider network data of individual users for the same provider (including both BSSID and SSID of wifi service provider stations). Our customers are permitted to use the data for the purpose of analyzing it and generating aggregated data relating to the performance of their networks or telecommunications equipment and to use aggregated data in their sales activities.This information does not reveal your specific identity (like your name or contact information) but may include device and usage information. Our customers are not permitted to use your personal data to communicate with you or to influence you or to profile or track individual users. They are required to keep your personal data confidential and to use appropriate means to protect it.

4. INTERNATIONAL DATA PROCESSING & TRANSFER

Where permitted under applicable laws, your personal data may be transferred to, stored, and processed outside of your jurisdiction, including, if you are an EU or UK-based user of the Services, in a country that is not regarded as ensuring an adequate level of protection for personal data under European Union law / by the European Commission or under UK law / by the UK Government, including the United States and Turkey.

We have put in place appropriate safeguards (such as contractual commitments) in accordance with applicable legal requirements to provide adequate protection for your personal data. 5. DATA SECURITY AND RETENTION

We implement technical and organisational measures to ensure a level of security appropriate to the risk to the personal data we process. These measures are aimed at ensuring the ongoing integrity and confidentiality of personal data. We evaluate these measures on a regular basis to ensure the security of the processing.

We retain your personal data for as long as we have a relationship with you. After our relationship has ended, we retain your information as long as required by law. We may also retain records to investigate or defend against potential legal claims, deal with any complaints or official enquiries or investigations regarding the Services, or maintain business records for analysis and/or audit purposes.

6. YOUR RIGHTS OVER YOUR PERSONAL DATA

You have certain rights regarding the personal data we hold about you, subject to local law. These may include the following rights:

  1. access – request a copy of your data and information relating to how it is processed;
  2. rectify – request any inaccuracies in the data we hold about you be corrected;

  7. withdraw your consent – where we are relying on your consent to process your data, then you can withdraw your consent at any time; and

7. CHILDREN'S INFORMATION

The Services are not directed to children, and we do not knowingly collect any personal data from children under the age of 13 (or such legally required age of consent as defined under applicable laws) or knowingly allow such person to register on our Services. In the event that we are notified that we have collect personal data from a child of or under the age of 13(or such legally required age of consent as defined under applicable laws) without parental consent, we will suspend the account and delete relevant information as quickly as possible. You may request a copy of this Notice from us using the contact details set out above. We may modify or update this Notice from time to time.

If we change this Notice, we will notify you of the changes. Where changes to this Notice will have a fundamental impact on the nature of the processing or otherwise have a substantial impact on you, we will give you sufficient advance notice so that you have the opportunity to exercise your rights (e.g. to object to the processing) or to terminate your use of the Services.

10. Indonesia-Specific Terms

If you are using our Services in Indonesia, the following additional terms shall apply. In the event of any conflict between the following additional terms and the provisions of the main body of this Notice, the following terms shall prevail.

11. LINKS TO THIRD PARTY WEBSITES AND SERVICES 

The App may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these apps or websites, please note that these have their own privacy policies and that we do not accept any responsibility or liability for those policies. Please check those policies before you submit any data to such apps or websites.

12. COOKIES AND OTHER TRACKING TECHNOLOGIES

Cookies : Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.
This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
